Estos términos de uso constituyen un acuerdo legal (“Acuerdo”) entre usted y Gerhard Bodner con domicilio fiscal registrado en Calle La Fuente, 49, El Gastor, 11687 Cádiz, España. ("Gerhard Bodner", "nosotros" o "nuestro”) el cual contiene los términos para las compras realizadas usted (la persona que completa el pedido “usted”) realiza mediante el sitio en internet www.gerhardbodner.com (el “Sitio”).
AL REALIZAR CUALQUIER COMPRA O MEDIOS DESCRITOS EN EL PRESENTE DOCUMENTO, USTED EXPRESA QUE HA LEÍDO ESTE ACUERDO Y ACEPTA SU CONTENIDO SIN RESERVAS, MODIFICACIONES, ADICIONES O ELIMINACIONES. SI USTED NO ESTÁ DE ACUERDO CON
LOS TÉRMINOS DE USO CONTENIDOS EN ESTE ACUERDO O SUS MODIFICACIONES, NO TENDRÁ ACCESO A REALIZAR COMPRAS, ASÍ COMO EN EL CASO DE QUE NO CUMPLA CON ALGUNA DISPOSICIÓN DE ESTE ACUERDO.
1. USUARIOS AUTORIZADOS
Usted deberá tener al menos 18 años. Al comprar usted declara que (i) ha leído y comprendido, y que está de acuerdo en estar obligado por este Acuerdo, y (ii) que tiene por lo menos la mayoría de edad. Si no está de acuerdo o no puede cumplir con alguno de estos términos y condiciones de este Acuerdo, por favor no acepte este Acuerdo.
2. INFORMACION DE LOS PRODUCTOS
Los productos de Gerhard Bodner se venden exclusivamente a través del Sitio o a través de las tiendas asociadas. Cualquier compra en otras boutiques o sitios web se hace enteramente a riesgo del comprador, particularmente en lo que se refiere a la autenticidad de tales artículos.
3. INFORMACIÓN DE LOS PRODUCTOS Y PROCESO DE PEDIDO
Para tramitar un pedido, debe ingresar al Sitio. Podrá conocer las características y precio total a pagar por los productos que desea adquirir a través del Sitio.
Para realizar un pedido, debe seguir el procedimiento de compra en línea y hacer clic en "Autorizar pago". Para procesar un pedido en el Sitio se le pedirá que proporcione su nombre, número de teléfono y dirección de correo electrónico. Usted declara y garantiza que la información personal que proporciona es verdadera, válida, completa y actualizada. Una vez validada su información, se aprobará el pedido, sujeto a los términos de este Acuerdo.
A continuación, recibirá un correo electrónico de acuse de recibo de su pedido. También le informaremos por correo electrónico cuando el producto este siendo enviado o en caso de que sea aplicable, cuando esté disponible para ser recogido.
La compra de productos en el Sitio está sujeta a disponibilidad. Si un producto se muestre en el Sitio como no disponible, Gerhard Bodner no tendrá obligación de procesar su pedido.
4. MÉTODOS DE PAGO
Una vez que procese un pedido a través del Sitio, le proporcionaremos antes de procesar el pago: (i) este Acuerdo, (ii) la Política de Privacidad, (iii) el resumen de los productos seleccionados y el importe total de su pedido para su revisión y consentimiento.
Posteriormente, el pago será procesado mediante el Sitio (salvo disposición en contrario en este documento) donde podrá pagar su compra utilizando una tarjeta de débito o crédito válida de VISA, MasterCard, American Express y PayPal.
Usted declara y garantiza que es el titular de la tarjeta correspondiente. Si su tarjeta es rechazada por el emisor de la tarjeta, su pedido no será enviado, y Gerhard Bodner no tendrá ninguna obligación de cumplir con su pedido.
La recepción de su pedido será confirmada mediante un correo electrónico automático a la dirección asociada a su cuenta.
5. ENVÍO
Su pedido será enviado a la dirección de entrega especificada por usted durante el proceso de pedido.
Los gastos de envío le serán informados con el coste total de su compra antes de completar la venta. Si no está de acuerdo con los gastos de envío, usted podrá rechazar la venta.
6. DEVOLUCIONES Y CAMBIOS
Los productos en perfecto estado pueden ser cambiados o devueltos dentro de los 30 (treinta) días siguientes a la fecha de compra original, siempre y cuando se presente recibo o factura original emitida (a excepción de artículos personalizados, relojes y joyas) y mediante el mismo medio que fueron adquiridos.
Para productos adquiridos en el Sitio o a través del Gerhard Bodner, las devoluciones y cambios solo podrán realizarse a través del Sitio o del Gerhard Bodner de acuerdo con los términos establecidos en el Sitio. No aplican cambios de productos adquiridos en el extranjero. El reembolso se realizará en el método original de pago al comprador original. No se podrá realizar un cambio de un producto que ya ha sido cambiado anteriormente.
7. POLÍTICA DE PRIVACIDAD
Las prácticas de Gerhard Bodner en materia de información personal se rigen por la Política de Privacidad de Gerhard Bodner. 8. TESTIMONIOS
Si nos envía o publica un testimonio, comentario, revisión, sugerencia o cualquier trabajo de autoría (colectivamente una "Presentación"), incluyendo, sin limitación, las Presentaciones sobre nuestros productos o servicios, dicha Presentación no será confidencial o secreta y podrá ser utilizada por nosotros de cualquier manera. Al enviarnos una Presentación, usted: (i) declara y garantiza que la Presentación es original para Usted, que ninguna otra parte tiene derechos sobre la misma, y que se ha renunciado a cualquier derecho moral sobre dicha Presentación, y (ii) Usted nos otorga un derecho libre de regalías, sin restricciones, a nivel mundial, perpetuo, irrevocable, no exclusivo y completamente transferible, derecho y licencia asignables y sub-licenciables para usar, reproducir, publicar, distribuir, mostrar, traducir, resumir, modificar y adaptar dicha Presentación (en su totalidad o en parte) e/o incorporarla en otros trabajos en cualquier forma, medio o tecnología ahora conocida o desarrollada posteriormente, a nuestra única discreción, con o sin su nombre.
9. RENUNCIA DE RESPONSABILIDADES
GERHARD BODNER NO SERÁ RESPONSABLE DE LOS DAÑOS, PÉRDIDAS, LESIONES Y CAUSAS DE ACCIÓN QUE SURJAN DE O EN RELACIÓN CON CUALQUIER PRODUCTO COMPRADO A GERHARD BODNER O SU USO O MAL USO, A MENOS QUE SEA UNA CONSECUENCIA DIRECTA DEL INCUMPLIMIENTO DE ESTE ACUERDO O DE LAS LEYES APLICABLES POR PARTE DE GERHARD BODNER.
10. INDEMNIZACIÓN
USTED NOS INDEMNIZARÁ Y NOS MANTENDRÁ A NOSOTROS, NUESTROS DIRECTORES, FUNCIONARIOS, EMPLEADOS, AFILIADOS, AGENTES, CONTRATISTAS Y LICENCIATARIOS, LIBRES DE RESPONSABILIDAD CON RESPECTO A CUALQUIER DEMANDA O RECLAMO QUE SURJA DE: (I) SU INCUMPLIMIENTO DE ESTE ACUERDO O A LA LEY APLICABLE, INCLUYENDO,PERO NO LIMITÁNDOSE A CUALQUIER VIOLACIÓN POR SU PARTE DE LOS DERECHOS DE AUTOR O DE PROPIEDAD INTELECTUAL DE CUALQUIERTERCERO.

12. GENERAL
Usted no sublicenciará, cederá o transferirá la licencia que se le ha concedido en virtud del presente Acuerdo. Cualquier intento de sublicenciar, ceder o transferir cualquiera de los derechos, deberes u obligaciones en violación de las disposiciones de este Acuerdo es nulo.
Este Acuerdo se regirá por las leyes de España.
Usted acepta que todas las disputas o reclamaciones entre usted y Gerhard Bodner que surjan de o en relación con este Acuerdo podrán ser sometidas primero a una conciliación ante la Procuraduría Federal del Consumidor, a su elección. En caso de que no sea posible resolver la controversia por la vía de la conciliación (si es el caso) las partes se someten expresa e irrevocablemente a la jurisdicción y competencia de los tribunales locales o nacionales, renunciando a cualquier otra jurisdicción que les pueda corresponder por su domicilio, presente o futuro, o por cualquier otra causa. Podemos enviarle avisos enviando un mensaje de correo electrónico a la dirección de correo electrónico que nos proporcionó, enviando una carta por correo a la dirección de contacto. Usted está de acuerdo en que podemos enviarle un aviso a través de dichos medios. A menos que se indique lo contrario en las notificaciones, éstas entrarán en vigor inmediatamente.
El hecho de que usted o nosotros no ejerzamos ningún derecho, facultad o recurso en virtud del presente documento o su demora en hacerlo no constituirá una renuncia a esos derechos, facultades o recursos, y todas las renuncias que hagamos serán por escrito. El ejercicio único o parcial de un derecho, facultad o recurso no impedirá su ejercicio posterior ni el ejercicio de cualquier otro derecho, facultad o recurso.
Los encabezados de las secciones son sólo por conveniencia y no se utilizarán para interpretar este Acuerdo.
Toda disposición del presente Acuerdo que por su naturaleza esté destinada a sobrevivir a la terminación del mismo sobrevivirá a dicha terminación.

ADEMÁS, RECONOCE QUE ESTE ACUERDO REPRESENTA EL ACUERDO COMPLETO Y EXCLUSIVO ENTRE USTED Y NOSOTROS Y QUE REEMPLAZA CUALQUIER PROPUESTA O ACUERDO PREVIO, ORAL O ESCRITO, Y CUALQUIER OTRA COMUNICACIÓN ENTRE NOSOTROS RELACIONADA CON EL TEMA DE ESTE ACUERDO.

These terms of use constitute a legal agreement ("Agreement") between you and Gerhard Bodner with registered office at Calle La Fuente, 49, El Gastor, 11687 Cadiz, Spain. ("Gerhard Bodner", "we", "us", "our" or "our") which contains the terms for purchases made by you (the person completing the order "you") through the www.gerhardbodner.com website (the "Site").
BY MAKING ANY PURCHASE OR USING ANY MEANS DESCRIBED HEREIN, YOU SIGNIFY THAT YOU HAVE READ THIS AGREEMENT AND ACCEPT ITS CONTENTS WITHOUT RESERVATION, MODIFICATION, ADDITION OR DELETION. IF YOU DO NOT AGREE TO THE TERMS OF USE CONTAINED IN THIS AGREEMENT OR ITS MODIFICATIONS, YOU WILL NOT HAVE ACCESS TO MAKE PURCHASES, OR IF YOU FAIL TO COMPLY WITH ANY PROVISION OF THIS AGREEMENT.
1. AUTHORIZED USERS
You must be at least 18 years of age. By purchasing you represent that (i) you have read, understand, and agree to be bound by this Agreement, and (ii) you are at least the age of majority. If you do not agree or cannot comply with any of these terms and conditions of this Agreement, please do not accept this Agreement.
2. PRODUCT INFORMATION
Gerhard Bodner products are sold exclusively through the Site or through partner shops. Any purchase from other boutiques or websites is made entirely at the risk of the purchaser, particularly with regard to the authenticity of such items.
3. PRODUCT INFORMATION AND ORDERING PROCESS
To place an order, you must log on to the Site. You will be able to find out the characteristics and total price to be paid for the products you wish to purchase through the Site. To place an order, you must follow the online purchase procedure and click on "Authorise payment". To process an order on the Site you will be asked to provide your name, telephone number and e-mail address. You represent and warrant that the personal information you provide is true, valid, complete and current. Once your information has been validated, your order will be approved, subject to the terms of this Agreement.
You will then receive an email acknowledging receipt of your order. We will also inform you by email when the product is being shipped or if applicable, when it is available for pick-up.
The purchase of products on the Site is subject to availability. If a product is shown on the Site as unavailable, Gerhard Bodner will have no obligation to process your order.
4. METHODS OF PAYMENT
Once you process an order through the Site, we will provide you with prior to processing payment: (i) this Agreement, (ii) the Privacy Policy, (iii) a summary of the products selected and the total amount of your order for your review and consent.
Thereafter, payment will be processed through the Site (except as otherwise provided herein) where you may pay for your purchase using a valid VISA, MasterCard, American Express and PayPal debit or credit card.
You represent and warrant that you are the cardholder of the relevant card. If your card is declined by the card issuer, your order will not be shipped, and Gerhard Bodner will have no obligation to fulfil your order.
Receipt of your order will be confirmed by an automatic e-mail to the address associated with your account.
5. SHIPPING
Your order will be shipped to the delivery address specified by you during the order process.
The shipping costs will be informed to you with the total cost of your purchase before completing the sale. If you do not agree with the shipping costs, you may refuse the sale.
6. RETURNS AND EXCHANGES
Products in perfect condition may be exchanged or returned within 30 (thirty) days from the date of original purchase, provided an original receipt or invoice is presented (with the exception of personalised items, watches and jewellery) and by the same means in which they were purchased.
For products purchased on the Site or through Gerhard Bodner, returns and exchanges may only be made through the Site or Gerhard Bodner in accordance with the terms set out on the Site. Exchanges do not apply to products purchased abroad. The refund will be made in the original method of payment to the original purchaser. It will not be possible to exchange a product that has already been exchanged previously.
7. PRIVACY POLICY
Gerhard Bodner's personal information practices are governed by Gerhard Bodner's Privacy Policy. For more information about how we process personal information we collect by telephone or online, the rights you, as a user, have in this regard, please see our Privacy Policy, which is incorporated by reference into these Terms of Use. Please review this Privacy Policy and print a copy for your records.
8. TESTIMONIALS
If you send or post a testimonial, comment, review, suggestion or any work of authorship (collectively a "Submission"), including, without limitation, Submissions about our products or services, such Submission will not be confidential or secret and may be used by us in any manner. By submitting a Submission to us, you: (i) represent and warrant that the Submission is original to you, that no other party has any rights in the Submission, and that any moral rights in such Submission have been waived, and (ii) you grant us a royalty-free, unrestricted, worldwide, perpetual, irrevocable, non-exclusive and fully transferable right, assignable and sub-licensable right and license to use, reproduce, publish, distribute, display, translate, abridge, modify and adapt such Submission (in whole or in part) and/or incorporate it in other works in any form, media or technology now known or later developed, in our sole discretion, with or without your name.
9. DISCLAIMER OF LIABILITY
GERHARD BODNER SHALL NOT BE LIABLE FOR ANY DAMAGES, LOSSES, INJURIES AND CAUSES OF ACTION ARISING OUT OF OR IN CONNECTION WITH ANY PRODUCT PURCHASED FROM GERHARD BODNER OR ITS USE OR MISUSE, UNLESS IT IS A DIRECT CONSEQUENCE OF GERHARD BODNER'S BREACH OF THIS AGREEMENT OR APPLICABLE LAWS.
10. INDEMNIFICATION
YOU WILL INDEMNIFY AND HOLD US, OUR DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS AND LICENSORS HARMLESS WITH RESPECT TO ANY CLAIM OR DEMAND ARISING OUT OF: (I) YOUR BREACH OF THIS AGREEMENT OR APPLICABLE LAW, INCLUDING, BUT NOT LIMITED TO, ANY INFRINGEMENT BY YOU OF THE COPYRIGHT OR INTELLECTUAL PROPERTY RIGHTS OF ANY THIRD PARTY.

12. GENERAL
You shall not sublicense, assign or transfer the license granted to you under this Agreement. Any attempt to sublicense, assign or transfer any of the rights, duties or obligations in violation of the provisions of this Agreement is void.
This Agreement shall be governed by the laws of Spain.
You agree that all disputes or claims between you and Gerhard Bodner arising out of or in connection with this Agreement may first be submitted to conciliation before the Procuraduría Federal del Consumidor, at its option. In the event that it is not possible to resolve the dispute through conciliation (if any) the parties expressly and irrevocably submit to the jurisdiction and venue of the local or national courts, waiving any other jurisdiction that may be available to them by reason of their domicile, present or future, or otherwise. We may send notices to you by sending an e-mail message to the e-mail address you provided to us, by sending a letter by post to the contact address. You agree that we may send you notice by such means. Unless otherwise stated in the notices, the notices will be effective immediately.
The failure of you or us to exercise any right, power or remedy hereunder or your delay in doing so shall not constitute a waiver of such right, power or remedy, and any waiver by us shall be in writing. No single or partial exercise of any right, power or remedy shall preclude its further exercise or the exercise of any other right, power or remedy.
Section headings are for convenience only and shall not be used to interpret this Agreement. Any provision of this Agreement that by its nature is intended to survive termination of this Agreement shall survive such termination. YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, UNDERSTAND IT AND WILL BE BOUND BY ITS TERMS AND CONDITIONS. YOU FURTHER ACKNOWLEDGE THAT THIS AGREEMENT REPRESENTS THE COMPLETE AND EXCLUSIVE AGREEMENT BETWEEN YOU AND US AND SUPERSEDES ANY PRIOR PROPOSALS OR AGREEMENTS, ORAL OR WRITTEN, AND ANY OTHER COMMUNICATIONS BETWEEN US RELATING TO THE SUBJECT MATTER OF THIS AGREEMENT.
